As a corporation that operates in Indonesia, Mekari Qontak must adhere to all Indonesian government rules. These restrictions are communication-related regulations enacted by the Ministry of Communication and Information, particularly, the ITE Law Article 27 paragraph (2) of Law 1/2024 or the ban of online gambling, which states:

Any person intentionally and without the right to distribute, transmit, and/or make accessible Electronic Information and/or Electronic Documents that contain gambling content.

1. "Distributing" is sending and/or disseminating electronic information and/or documents to many people or various parties through an electronic system.
2. "Transmitting" is sending electronic information and/or documents addressed to another party through an electronic system.
3. "Making accessible" is all other actions other than distributing and transmitting through an electronic system that cause electronic information and/or documents to be known to other parties or the public.

Those who violate the provisions of Article 27 paragraph (2) of Law 1/2024 are potentially subject to a maximum imprisonment of 10 years and/or a maximum fine of IDR 10 billion, as stipulated in Article 45 paragraph (3) of Law 1/2024.

Article 303 of the Criminal Code also states that gambling is prohibited in Indonesia. With this regulation, we want to ensure that all information (in the form of outgoing messages such as Broadcast) must comply with regulations that do not support the dissemination of information related to online gambling. We also do not tolerate any account that knowingly uses our services to promote this.

Based on this, we will implement Artificial Intelligence technology to run the Broadcast Template Checker, where AI will be the checker to ensure that every template message creation on Qontak does not contain online gambling information in any form. This feature will be applied to all users on all packages.

Here's how it works:

1. We will run this feature every 1 hour. In this case, every new template created will be checked by AI first.
2. After being checked, AI will provide 3 criteria: Low Risk, Medium Risk, and High Risk.
3. This risk is defined by 3 parameters: Spam Probability, Online Gambling Probability, and Deposit Credit Gambling Probability.
4. If we find a template that is categorized as Medium or High Risk, we will manually check it first to filter it by matching your company profile and the template.
5. If we do not find any suspicious words or intents in the template for Medium Risk, then no action is required.
6. For High Risk templates, we will send an email to your account stating that your template violates the rules and we will deactivate the template.

Qontak as an Omnichannel CRM service has the right to deactivate templates with/without notice as stated in our terms and conditions via the link https://qontak.com/syarat-dan-ketentuan/ section I. General Provisions, Clause M. Others paragraph (5).

Based on these terms and conditions, Qontak has the right to terminate some access (in this case, access for Broadcast) if based on Qontak's assessment it is indicated as a violation of applicable laws and regulations, in this case gambling. This termination can be done with/without prior notice. With this initiative we hope to provide better and safer services, not only to our users, but also to our customers. Thank you.
